Section 1

Acceptance of Terms

These Terms and Conditions, including the Privacy Policy in Section 10 (collectively, these "Terms"), govern your access to and use of the Bollywood.NYC website at bollywood.nyc, the Bollywood.NYC email newsletter, the @212.Bollywood.NYC Instagram account, and any related services, content, or channels we operate (collectively, the "Service"), all of which are operated by Snaps Media Group LLC, a New Jersey limited liability company ("Snaps Media," "we," "us," or "our").

By accessing, browsing, subscribing to, submitting content to, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Section 2

About Bollywood.NYC

Bollywood.NYC is a publication of Snaps Media Group LLC dedicated to South Asian cultural life in the New York metropolitan area. The Service currently includes:

The Bollywood.NYC weekly email newsletter, typically delivered Thursday mornings
The bollywood.nyc website, including event calendars, editorial features, the Stories & Features section, and related editorial content
The @212.Bollywood.NYC Instagram account
Any future channels, products, or services we may launch under the Bollywood.NYC name

Section 3

Eligibility

You must be at least thirteen (13) years old to subscribe to the newsletter, submit content, or otherwise interact with the Service. If you are between the ages of 13 and 18, you represent that you have your parent's or legal guardian's permission to use the Service and to agree to these Terms on your own behalf. The Service is intended for users in the United States; users in jurisdictions where these Terms are unenforceable are not authorized to use the Service.

Section 4

Our Intellectual Property

All content on the Service — including but not limited to text, articles, essays, editorial features, event listings, photographs, illustrations, graphics, design, layouts, source code, the "Bollywood.NYC" name and logo, and all related trademarks, trade names, and trade dress — is the exclusive property of Snaps Media Group LLC or its licensors, and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, publicly display, transmit, modify, create derivative works of, frame, mirror, scrape, or otherwise exploit any portion of the Service or its content for commercial purposes without our prior written consent. You may:

Share links to articles using the share functions provided on the Service
Quote brief excerpts with proper attribution to Bollywood.NYC for noncommercial purposes such as journalism, commentary, or criticism, consistent with fair use under U.S. copyright law
Forward the email newsletter to friends in its complete, unaltered form

Section 5

Submissions & Contributions — Assignment of Rights

Please read this section carefully. It governs the ownership of anything you send us.

If you submit, contribute, send, post, transmit, or otherwise make available to Bollywood.NYC any content — including but not limited to personal essays, interviews, reflections, articles, comments, photographs, audio, video, illustrations, pitches, story ideas, edits, suggestions, feedback, event listings, tips, sources, or any other materials, in any medium or format, whether requested by us or unsolicited (collectively, "Submissions") — the following terms apply:

(a) Assignment of All Rights

You hereby irrevocably and unconditionally assign, transfer, and convey to Snaps Media Group LLC, in perpetuity and throughout the universe, all right, title, and interest in and to your Submission and any derivative works thereof, including without limitation all copyrights, all rights to reproduce, distribute, publish, perform, display, edit, adapt, translate, license, sublicense, and prepare derivative works, in all media and formats now known or hereafter devised. Snaps Media Group LLC shall be the sole and exclusive owner of all such Submissions. You retain no rights in your Submission once assigned under this Section.

(b) Waiver of Moral Rights

To the maximum extent permitted by applicable law, you irrevocably waive, and agree never to assert, any and all moral rights or rights of a similar nature (including any rights of attribution and integrity) you may have in your Submission. Nothing in these Terms obligates us to publish, attribute, credit, or compensate you for your Submission, although we may, at our sole discretion, provide a byline, credit, attribution, or honorarium.

(c) Further Assurances

At our request, you agree to execute any documents and take any actions reasonably necessary to confirm or perfect Snaps Media Group LLC's ownership of your Submission, including providing a signed assignment in a form we may reasonably require.

(d) Your Representations and Warranties

By submitting any content to us, you represent and warrant that:

You are the sole author and original creator of the Submission, or you have obtained all necessary rights, permissions, licenses, and consents to grant the assignment in subsection (a);
The Submission is your original work and does not infringe, violate, or misappropriate any third party's intellectual property rights, rights of privacy, rights of publicity, contractual rights, or any other rights;
Any statements of fact in the Submission are true to the best of your knowledge, and you have a good-faith basis for any opinions expressed;
The Submission is not defamatory, obscene, threatening, harassing, discriminatory, unlawful, or otherwise objectionable;
Any individuals identifiable by name, image, voice, or other identifying information in the Submission have given you their informed consent to such use, and you have records of such consent that you will provide to us upon request;
You are not under any obligation to any third party (such as an employer or other publisher) that would prevent or restrict the assignment under subsection (a).

(e) Editorial Discretion

We reserve the absolute right, in our sole discretion, to edit, revise, condense, expand, retitle, format, illustrate, translate, fact-check, annotate, or otherwise modify any Submission for publication or any other use. We may decline to publish any Submission for any reason or no reason, and we may publish, withdraw, archive, or de-publish content at any time without notice.

(f) No Confidentiality

Submissions are not made on a confidential basis. Do not include in any Submission any information you wish to keep confidential or that is subject to a non-disclosure obligation.

(g) Indemnification for Submissions

You agree to indemnify, defend, and hold harmless Snaps Media Group LLC and its members, officers, employees, contractors, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to (i) any breach by you of the representations and warranties in subsection (d); or (ii) any third-party claim relating to your Submission.

(h) No Obligation

We are under no obligation to use any Submission. Unsolicited Submissions are reviewed only as time and editorial capacity permit, and we cannot guarantee a response.

Section 6

User Conduct

When using the Service, you agree not to:

Use the Service for any unlawful purpose or in violation of these Terms;
Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
Submit false, misleading, deceptive, or fraudulent content;
Harass, threaten, defame, stalk, or otherwise harm any other person;
Attempt to gain unauthorized access to the Service, our servers, or any data we hold;
Transmit viruses, malware, worms, or other harmful code;
Use bots, scrapers, crawlers, or other automated means to access the Service without our prior written consent;
Systematically download, reproduce, or harvest content from the Service;
Interfere with or disrupt the Service or the servers and networks that host it;
Use the Service or our content to train any machine-learning or artificial-intelligence model without our prior written consent.

Section 8

Event Listings

Bollywood.NYC includes listings of events, performances, and gatherings curated from publicly available sources, third-party promoters, venues, and unsolicited submissions. We do not organize, host, sponsor, or endorse these events unless explicitly stated. We provide listings as an editorial convenience to our readers.

We are not responsible for, and disclaim all liability arising from:

Event cancellations, postponements, venue changes, or other changes to event details;
Ticket purchases, refunds, exchanges, or disputes with ticketing platforms;
The content, quality, accessibility, accuracy of advertising, or experience of any event;
Disputes between attendees and event organizers, venues, performers, or other attendees;
Any injury, loss, damage, or expense arising from your attendance at any event.

Always verify event details directly with the official ticketing source or organizer before purchasing tickets or attending. Links to third-party ticketing platforms are provided for convenience.

Section 9

Third-Party Links and Services

The Service may contain links to third-party websites, services, or resources. We do not endorse and are not responsible for the content, accuracy, completeness, or practices of these third parties. Your use of any third-party site or service is at your own risk and subject to the terms and privacy policies of those third parties.

Section 10

Privacy Policy

This Privacy Policy describes the information we collect about you, how we use it, and your choices regarding it. By using the Service, you consent to the practices described here.

(a) Information We Collect

Newsletter subscribers. When you subscribe, we collect your email address, the date and source of your subscription, and email engagement data (such as opens, clicks, and unsubscribes) through our email service provider.

Website visitors. When you visit bollywood.nyc, we and our service providers may automatically collect standard server log data, including your IP address, browser type and version, device type, operating system, pages visited, time spent, and referring URL. We may use analytics tools to understand site usage in aggregate.

Submissions. If you submit content to us, we collect any personal information you voluntarily include in the Submission and any contact information you provide.

Advertising and referrals. If you arrive via a paid advertisement on Meta (Facebook or Instagram) or another platform, those platforms may share with us aggregated, non-personally-identifying campaign performance data.

(b) How We Use Your Information

To deliver the newsletter you subscribed to and related service messages;
To review, edit, and publish Submissions;
To respond to inquiries, pitches, and other communications;
To improve our editorial content, design, and overall Service;
To measure and analyze audience engagement and advertising performance in aggregate;
To detect, prevent, and address fraud, abuse, security incidents, or violations of these Terms;
To comply with our legal obligations.

(c) Information We Do Not Collect or Sell

We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will delete it.
We do not sell your personal information to third parties.

(d) Cookies and Similar Technologies

The Service may use cookies, web beacons, and similar tracking technologies to remember preferences, measure engagement, and improve performance. You can configure your browser to refuse cookies or alert you when cookies are being sent, but some features of the Service may not function correctly if you do.

(e) Third-Party Processors

We rely on third-party service providers to operate the Service. These providers include, currently and from time to time: MailerLite (newsletter delivery), Meta Platforms (advertising and Instagram presence), Google (analytics and infrastructure), our domain registrar and web host, and providers of payment, scheduling, and editorial tools. Each such provider has access only to the data needed to perform its function and is bound by its own privacy policy.

(f) Your Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or restrict processing of your personal information, to opt out of certain processing, or to receive a portable copy of your data. To exercise any of these rights, contact us at contact@bollywood.nyc. We will respond within a reasonable time consistent with applicable law.

(g) Data Retention

We retain newsletter subscriber data for as long as you remain subscribed, and for a reasonable period thereafter for legal, operational, and historical purposes. Published Submissions become part of our editorial archive and may be retained indefinitely, including after you cease being a contributor or subscriber.

(h) Security

We take reasonable, industry-standard measures to protect personal information from unauthorized access, alteration, or destruction. However, no internet transmission or electronic storage is fully secure, and we cannot guarantee absolute security.

(i) International Users

The Service is operated in the United States. If you access the Service from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.

Section 11

Disclaimers

The Service and all content on it are provided "as is" and "as available" without warranties of any kind, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of any event listing, editorial content, or other information. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Section 12

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Snaps Media Group LLC, its members, officers, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service, any Submission, any event, or any third-party content or service, even if advised of the possibility of such damages. Our total aggregate liability to you for all claims arising out of or related to these Terms or the Service shall not exceed one hundred U.S. dollars ($100).

Section 13

Indemnification

You agree to indemnify, defend, and hold harmless Snaps Media Group LLC and its members, officers, employees, contractors, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to (i) your use of or access to the Service; (ii) any Submission you provide; (iii) your violation of these Terms; or (iv) your violation of any third-party right, including any intellectual property, privacy, or publicity right.

Section 14

Termination

We may, in our sole discretion, suspend, restrict, or terminate your access to all or any part of the Service at any time, with or without notice, for any reason or no reason, including for violation of these Terms. We may also discontinue the Service in whole or in part at any time.

The provisions of these Terms that by their nature should survive termination shall survive, including without limitation Sections 4 (Intellectual Property), 5 (Submissions & Contributions), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), and 15 (Governing Law).

Section 15

Governing Law & Disputes

These Terms and any dispute or claim arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. You and Snaps Media Group LLC agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in New York County, New York, and each party hereby submits to the personal jurisdiction of those courts and waives any objection based on inconvenient forum.

To the extent permitted by law, you waive any right to participate in a class action, class arbitration, or other consolidated proceeding against us, and you and we each waive any right to a trial by jury.

Section 16

Changes to These Terms

We may modify these Terms at any time. When we do, we will post the updated Terms on this page and update the Effective Date at the top. If the changes are material, we may also notify subscribers by email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree, stop using the Service.

Section 17

Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be construed to give it the maximum lawful effect, and the remaining provisions shall continue in full force.

These Terms constitute the entire agreement between you and Snaps Media Group LLC concerning the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us regarding the Service.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms freely.
